Terms of Service

By creating an account, installing the AbleBP+ mobile app, or using the AbleBP+ website (together, the "Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. The Service is operated by AbleSpark ("we", "our", "us").

AbleBP+ lets you record, organize, view trends in, and export blood pressure readings for yourself and for family members or others you support. You can invite trusted people to view or help log readings. The Service includes:

• Logging systolic, diastolic, pulse, arm, notes, and recorded time
• Tracking readings for multiple people in one account
• Inviting others to view or help log on your behalf
• Exporting data as CSV, PDF, or JSON
• Offline-capable mobile app with encrypted local storage

You must be at least 18 years old to create an AbleBP+ account. Adults may track readings for minors or other adults under their care, provided they have the legal authority or relational basis to do so (for example, a parent of a minor, a legal guardian, a holder of a power of attorney, or with the verbal permission of a capable adult).

If you create a profile to track another person's readings, you confirm at the time of creation that you have the right to do so and that the information you record is accurate.

You are responsible for keeping your password secure, for any activity that occurs under your account, and for the accuracy of the information you record.

• Do not share your password with anyone
• Use the in-app sharing feature, not your password, to give others access
• Keep your email address current so you can recover your account
• Notify us promptly at support@ablebp.com if you believe your account has been accessed without your authorization

You agree not to:

• Use the Service to record health data about a person without their knowledge or a lawful basis to do so
• Attempt to access another user's account or data
• Reverse engineer, decompile, or attempt to extract source code from the Service
• Use the Service to transmit malware, harmful code, or unlawful content
• Use automated systems to scrape, copy, or overload the Service
• Resell, sublicense, or commercially redistribute the Service without our written consent
• Use the Service in a way that violates any applicable law

The readings, notes, and other information you record in the Service ("Your Content") belong to you. You grant us a limited license to host, store, transmit, and display Your Content solely so we can provide the Service to you and to people you have invited.

We do not claim ownership of Your Content. We do not sell Your Content. We do not use Your Content to train machine learning models or for any purpose other than providing the Service to you.

When you invite another person to view or help log readings, you choose their access level (Full control, Can edit, or View only) and you can revoke that access at any time from the app. You are responsible for choosing who you invite.

If someone invites you to access their data, you agree to use that access only as the inviter intended and to handle their information with appropriate care.

Your use of the Service is also governed by our Privacy Policy and, for health data specifically, our Consumer Health Data Privacy Policy. By using the Service you consent to the data practices described there.

The AbleBP+ name, the AbleBP+ logo, the design and code of the app and website, and all related materials are owned by AbleSpark and protected by copyright, trademark, and other laws. We grant you a personal, limited, non-transferable, revocable license to use the Service for your own non-commercial use, subject to these terms.

You may delete your account at any time from the Profile page. Doing so will permanently delete your account, your readings, and any patient profiles you own. Pending invitations will be cancelled.

We may suspend or terminate your access if you violate these terms, if we are required to do so by law, or if continued use of the Service by you would create a risk to other users. Where reasonable, we will give you prior notice and an opportunity to export your data.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, secure against every threat, or that any data you record will be retained without loss. You are responsible for keeping your own copies of any data that is important to you, which you can do at any time using the export feature.

To the maximum extent permitted by law, AbleSpark and its affiliates, officers, employees, agents, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, goodwill, or other intangible losses, arising from or related to your use of the Service.

Our total cumulative liability for any claim arising from or related to the Service is limited to the greater of (a) the amount you have paid us for the Service in the twelve months preceding the claim, or (b) one hundred U.S. dollars (US$100). Some jurisdictions do not allow these limitations, in which case they apply to the fullest extent permitted by law.

You agree to indemnify and hold AbleSpark harmless from any claim, demand, loss, or damages, including reasonable attorneys' fees, arising out of your misuse of the Service, your violation of these terms, or your violation of any rights of another person, including any person whose health data you record without authorization.

We may update these terms from time to time. If a change is material, we will notify you in the app or by email before the change takes effect. Your continued use of the Service after the effective date of an updated version constitutes acceptance of the changes. If you do not agree to a change, you may delete your account.

These terms are governed by the laws of the State of [your state], United States, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these terms or the Service will be brought exclusively in the state or federal courts located in [your county/state], and you and AbleSpark consent to the personal jurisdiction of those courts.

Note: replace the bracketed values with your operating state and county before publication. We've kept arbitration out of the baseline; add it later with counsel review if you want it.

If you obtained the AbleBP+ app from the Apple App Store, the following additional terms apply, and they take precedence over the rest of these terms in case of conflict:

• These terms are between you and AbleSpark only, not with Apple. AbleSpark, not Apple, is solely responsible for the app and its content.
• Apple has no obligation to provide any maintenance or support services for the app.
• If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation.
• AbleSpark, not Apple, is responsible for addressing any claims by you or a third party relating to the app, including product liability claims, claims that the app fails to conform to any legal requirement, and claims arising under consumer protection or similar legislation.
• If a third party claims the app or your use of it infringes their intellectual property rights, AbleSpark, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of any such claim.
• You represent that you are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. government list of prohibited or restricted parties.
• Apple and Apple's subsidiaries are third-party beneficiaries of these terms, and upon your acceptance of them, Apple has the right (and is deemed to have accepted the right) to enforce these terms against you as a third-party beneficiary.
